Inland Fisheries Bye Laws 1997-2010 by River

General

River Nore

River Nore Bye-Law 2010

This Bye-Law provides for catch and release in respect of salmon and sea trout (over 40 cm) in the River Nore during the period 17 March to 11 May, 2010 and a bag limit of 3 fish during the period 12 May to 30 September, 2010 subject to a daily bag limit of 1 fish during this period. The Bye-law also provides for the use of single barbless hooks and prohibits the use of worms as bait in angling for salmon and sea trout (over 40 cm). Read the full bye-law, [.doc, 54KB].

River Nore Angling Bye-law No. 852, 2008

The Nore has a small surplus of 465 for the 2009 season and the river is open for anglers on a Catch and Release basis during the season. This Bye-law provides for a bag limit of one fish only during the period 1 September to 30 September 2009 in order to offer further protection for salmon and sea trout stocks.

River Barrow

Bye-Law (No. 103), No. 3 or Waterford District, River Suir, Nore, and Barrow conjoined, dated 15 July 1884

Prohibits the use of any drift net for the capture of salmon or trout in the tidal portions of the River Suir, Nore and Barrow conjoined, above a line drawn due to west across the River from Kilmokea Point, Co. Wexford, to Drumdowney Point, Co. Kilkenny, and a line drawn due south from the said Drumdowney Point to a point on the opposite shore in Co. Waterford.

No. 3 or Waterford District Bye – Law (No.131), dated 18 January 1890

Prohibits the use in the River Barrow between Athy Bridge and the Weir at Bagenalstown, Cos. Kildare and Carlow, or in the River Burren or its tributaries, Co. Carlow any night line for the capture of fish of any kind.

No. 3 or Waterford District, Net Fishing – River Barrow, By-Law (No.135), dated 23 October 1891

Prohibits the use of any net for the capture of salmon or trout in that part of the tidal waters of the River Barrow between the navigation weir known as St. Mullin’s Weir and the imaginary line drawn across the River at the mill known as St. Mullin’s Mill, about one mile (1.61km) below St. Mullins Weir, in Cos Carlow and Kilkenny.

No. 3 or Waterford District, By-Law (no. 137), dated 31 October 1891

Prohibits the use of any drift or seine net for the capture of salmon or trout in the tidal waters of the Rivers Barrow and Nore conjoined, between a line across the River at St. Mullins Mill and an imaginary line between across the river at right angles from the northern boundary of the townland of Carrickloney, Co. Kilkenny, to a point on the opposite bank in the townland of Dungantown, Co. Wexford, and also below or seaward of an imaginary line drawn across the River at right angles from a point called Garraunbaun Rock in the townland of Drumdowney Upper, Co. Kilkenny, to a point on the opposite bank near Louthtown, in the townland of Great Island, Co. Wexford.

No. 3 or Waterford District, By-Law (No. 139) , dated 3 November 1891

Prohibits the use of any drift or seine net longer than 120 yards (109.73 m) for the capture of salmon or trout in that part of the tidal waters of the Rivers Barrow and Nore conjoined situated between an imaginary line drawn across said River at right angles from a point called Garraunbaun Rock in the townland of Drumdowney Upper, Co. Kilkenny, to a point on the opposite bank near Loughtown, in the townland of Great Island, Co. Wexford.

No. 3 or Waterford District, River Barrow and Tributaries, By-Law No. 172, dated 22 June 1896.

Prohibits the use of any night line for the capture of fish of any kind in that part of the River Barrow and its tributaries above Athy Bridge.

River Barrow (Clashganny – Cloghastia Weir) Bye-Law No. 461, 1949

Prohibits

(i) fishing by any means in that portion of the River Barrow within 50 yards (45.72m) downstream of any point on the crest of the weir’s known as the Clashganny-Cloghast Weir, otherwise known as the Cloghasty-Cournellan Weir,

(ii) the possession of any fishing rod with line attached thereto in any of the following places –

(a) at or upon the weir known as Clashganny-Cloghastia Weir, situated between the townland of Cloghasty South, Co. Kilkenny, and the townland of Cournellan, Co. Carlow:

(b) at any point on the downstream side of the said Weir situated within a distance of 50 yards (45.72m) of the crest thereof;

(c) at any point on the right bank of the River Barrow situated within 50 yards (45.72m) of the point at which the crest of the said Weir joins the said right bank of the River Barrow.

River Suir

No. 3 or Waterford district, Net fishing – River Suir, By-law (No. 140) 6 November 1891

Prohibits the use of any drift or seine net for the capture of salmon or trout in that part of the tidal waters of the river Suir situated above an imaginary line drawn at right angles across the River from the mouth of the stream forming the boundaries of Counties Kilkenny and Tipperary to the opposite bank.

No. 3 or Waterford District, Net Fishing – River Suir, Bye-law (No. 141), dated 30 November 1891

Prohibits the use of any net for the capture of salmon or trout in that part of the tidal waters of the River Suir situated between a line drawn across the River at the head or upstream end of the piers or walls of the Canal or Navigation Basin at Carrickbeg, Co. Waterford, and a line drawn across the river about 200 yards (182.88m) below the tail or downstream end of the said piers or walls.

No. 3 or Waterford District, Net Fishing – River Suir, By-Law (No. 169) , dated 11 February 1896

Prohibits the use of any drift or seine net of greater length than 40 yards (36.58m) in that part of the tidal waters of the River Suir and tributaries situated between an imaginary line drawn at right angles across the River Suir from the mouth of the stream forming the boundaries of Counties Kilkenny and Tipperary to the opposite bank, and the Wooden Bridge at Fiddown.

Waterford District Bye-Law No. 477 1951, dated 23 November 1931

Prohibits taking or attempting to take fish in the portion of the River Suir north of Suir Island at Clonmel between Old Bridge and an imaginary straight line drawn across the river in continuation of the west side of Abbey Street, or in the mill tail races discharging into the River Suir within those limits. This prohibition does not apply to fishing with single rod and line from that part of the north bank of the river known as Old Quay.

Bessborough Demesne

Bye-law (no. 27), Waters in, and Rivers running through the Demesne of Bessborough in the County of Kilkenny, dated 5 June 1865

Permits the use of nets for the capture of fish with meshes of 1 inch (2.54cm) from knot to knot or 4 inches (10.16cm) the round, such measurements to be taken in the clear when the net is wet, within the waters in, and rivers running through, the Demesne of Bessborough, Co. Kilkenny, provided that no net having a less mesh than 1 ¾ inches (4.45cm) from knot to knot shall be used in the said rivers during the months of April, May and June.

River Burren

Canal at Lodge Mills. Co. Carlow

Wexford District Bye-law no. 497, 1958, dated 17 November 1958

Prohibits

(i) fishing by any means whatsoever

(a) in that portion of the canal at the Lodge Mills, Muine Bheag, Co. Carlow, extending from the uppermost lock gate at Lodge Mills to an imaginary straight line drawn across the canal at right angles to its course 210 yards (192.02) downstream from the said lock gate,

(b) in the tail race of Lodge Mills discharging into the said canal,

(ii) possession of any mounted fishing rod with line attached thereto on the banks along that portion of the canal or of the tail race as specified above within an area extending for a distance of 7 yards (6.40m) from each bank edge.

Corrock River

Bye-law (No. 36) , No. 3 or Waterford district, River Corrock, dated 7 July 1870

Permits the use of nets with meshes of 1 inch (2.54cm) or 4 inches (10.16) in the round, measurements to be taken in the clear when the net is wet, within that part of the River Corrock situated above Wellington Bridge, during the open season for the capture of salmon and trout in that river.

Lismore District

General

Bye-Law (No. 95) , No. 4 or Lismore District, dated 31 August 1881

Prohibits possession of any net for the capture of salmon or trout in or on board any boat, cot, curragh, or other vessel in the tidal waters of the District between 8 a.m. on Saturday and 4 a.m. on the following Monday.

No. 4 of Lismore District, By-Laws (No. 208) Night Lines – Shooting Fish, dated 20 April, 1898

Prohibits the following in any of the fresh waters of the District

(i) the use of any night line for the capture of any fish,
(ii) shooting or attempting to shoot fish.

By-Law (No. 315) No. 4 or Lismore District, dated 22 October 1912

Prohibits shooting in Ardmore Bay, inside or northwest of an imaginary straight line from Ardmore Head to Mine Head, of any drift net for the capture of salmon, or any part of such drift net, within 150 yards (137.16m) of any other such drift net that is already in the water and fishing.

Lismore District By-Law No. 445, dated 9 January 1942

Prohibits

(i) taking and killing , by any means in any of the waters of the District, of any fish of the salmon or trout kind of less than 7 inches (17.78cm) in length measured in a straight line from the tip of the snout to the fork of the tail,

(ii) possession on or near the banks of the said waters of any such fish of less than the said length. Any such fish, if taken, must be returned alive to the water.

Lismore District Bye-Law No. 483, 1954, dated 20 January 1954

Prohibits

(i) the use of a gaff as auxiliary to fishing with single rod and line for the purpose of taking, or with intent to take, fish in the District during the annual close season for the capture of salmon by rod and line,

(ii) possession of a gaff on or near the banks of any river or lake in the District during the annual close season for the capture of salmon by rod and line.

Lismore District Bye-Law No. 543, 1968, dated 29 July 1968

Prohibits using or attempting to use or possession in or on any boat or on or near the waters of the District for the capture of salmon of

(i) any snap net of greater length than 20 yards (18.29) of which any meshes exceeds in length 2 ¾ inches (6.99cm) from knot to knot, such measurement to be taken when the net is wet

(ii) and drift net of which any mesh exceeds in length 2 ½ inches (6.35cm) from knot to knot (such measurements to be taken when the net is wet) .

River Blackwater

River Blackwater etc., No. 4 or Lismore District, Drift Nets Bye-Laws (No. 60), dated 6 November 1874

Prohibits the use of drift nets as a less distance from each other than 50 yards (45.72cm) in that portion of the River Blackwater within one mile (1.61km) of the defined mouth of the River. Each drift net shot and drifting is to be kept at a distance or not less than 50 yards (45.72cm) from the one preceding it on the tide and already drifting.

Bye-Law (No. 78), No. 4 or Lismore District, River Blackwater, dated 14 March 1878.

Prohibits the use for the capture of salmon or trout of any drift net in the tidal portion of the River Blackwater, or its tributaries, above or to the north of a line drawn across the said River from the townland boundary between the townlands of Strancally and Newport East, on the west, Ballynaclash, on the east, all in Co. Waterford.

No. 4 or Lismore District, River Blackwater, Clondulane Weir, Bye-Law (No. 121), dated 7 January 1888

Prohibits fishing for salmon or trout, by any means whatsoever, from or off the mill-dam at Clondulane on the River Blackwater, Co. Cork, or from any place within a space of 30 yards (27.43m) below the said mill-dam.

No. 4 or Lismore District, Salmon Fisheries, Draft Net Fisheries Bye-law (No. 123), dated 30 June 1888.

Prohibits the use of draft nets of greater length than 170 yards (155.45m) for the capture of salmon or trout in any portion of the River Blackwater or its tributaries.


Bride River Netting Bye-Law No. 430, 1943, dated 30 April 1943

Prohibits

(i) the following in relation to any net for catching fish or capable of catching fish (save a landing net used only as an auxiliary to fishing legally with a single rod and line) :

(a) the use of such a net in that portion of the River Bride situated above Camphire Bridge which connects the townslands of Camphire and Headborough,

(b) possession on board any boat, cot, curragh or other vessel, in that part of the Bridge River situated above the aforesaid Camphire, of any such net,

(c) control or possession, on or near the banks of the Bride River situated above the aforesaid Camphire Bridge, of any such net,

(II) possession on board any boat, cot, or curragh or other vessel, in that part of the Bride River between the tidal and freshwater boundary and the aforesaid Camphire Bridge, of any salmon or trout.

C.S. 266,1998 - Southern Fisheries Region Bye-law

Prescribes the commencement date of the annual close season for salmon and trout in the No. 3 Waterford District as 1 October and ending on 16 March in the following year. Signed 29 September 1998.

No. 732 of 1997 - Southern Fisheries Region Byelaw

Limits the maximum size of fyke nets in the Southern Fisheries Region to 52 cm (20 inches). Signed on the 27 March, 1997.

No. 3 or Waterford District, By-Laws (No. 230), dated 2nd March 1900

Prohibits shooting or snaring of, or groping for, fish in any river in the District.

By-Law (No. 391) No. 3 or Waterford District, dated 28 December 1928

Prohibits:
1. beating the water or throwing stones or other missiles therein for the purpose of driving fish close into the banks of any rivers in the Distirct,
2. the possession of any net for the capture of salmon or trout in or on board any boat, cot, curragh, or other vessel in the tidal waters of the District at any time between 8am on Saturday and 4 pm on the following Monday.
